Why file bankruptcy?

Usually it is one of the big three that results in a bankruptcy filing: Divorce, Job Loss, Illness. These situations put families and businesses on uneven financial footing. But whatever the reason is, bankruptcy laws exist to help you start over fresh.

What is bankruptcy?

In general, there are two forms of consumer bankruptcy, Chapter 7 and Chapter 13.

Chapter 7 is what most people think of when they think of bankruptcy. It wipes out unsecured debt (credit cards, medical bills, check cashing, loans, traffic fees, etc.) and you get a "fresh start."

Chapter 13 is a bit different. You go on a three to five year payment plan to get caught up on secured debt (your mortgage, your car payment) and pay back a portion of your unsecured creditors, sometimes as little as a penny on the dollar.

What does it cost?
